Welcome to My Hype Song (“we,” “us,” “our”). By using our website and/or placing an order, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our site or purchase our products.
1. WHAT WE SELL
My Hype Song creates custom digital audio content, including hype songs, team anthems, lyrics, and related digital deliverables (“Digital Product”). Deliverables are typically provided by email and may include audio files, lyrics, links to digital files, or other related materials. Our products are custom digital goods created from the information you provide. They are intended for personal motivation, entertainment, celebration, and team spirit.
2. AI-ASSISTED CREATION
My Hype Song uses a combination of human direction, automation, artificial intelligence tools, music generation tools, and other third-party platforms to create and deliver Digital Products. By placing an order, you understand and agree that your submitted information may be processed through AI-assisted systems and third-party services as part of creating, reviewing, delivering, revising, or supporting your order. We do not guarantee that AI-generated or AI-assisted output will be perfect, error-free, or exactly match a customer’s subjective expectations. We will make reasonable efforts to provide a quality custom product based on the information submitted.
3. ORDERS, DELIVERY, AND REVISIONS
Turnaround: Typical delivery is one to three business days, unless we tell you otherwise. Turnaround times are estimates, not guarantees.
Delivery method: We deliver to the email address you provide at checkout or on the order form. You are responsible for entering a correct email address and checking your inbox, spam, promotions, or junk folders.
Customer information: You are responsible for submitting accurate names, spellings, pronunciation notes, team details, email addresses, and other order information. We are not responsible for errors caused by incorrect, incomplete, or unclear information submitted by the customer.
Revisions: If your purchase includes revisions, or if we choose to offer them, revisions are limited to reasonable adjustments, such as pronunciation tweaks, minor lyric changes, delivery/link issues, or correction of clear mistakes. Revisions do not include creating an entirely new product from scratch unless explicitly stated by us in writing. We may refuse revision requests that are unreasonable, abusive, unlawful, impossible to complete, unrelated to the original order, or outside the scope of the product purchased.
4. PAYMENTS, CREDITS, AND COUPONS
Pay by card: If you choose to pay by card, your payment is processed by our payment provider. We do not store full payment card numbers.
Pay using credits: If you purchased a pack or deal that includes credits, credits are tied to the buyer email address, non-transferable, redeemable only while available and valid in our system, not redeemable for cash, and not refundable once used toward an order. If you submit an order using credits but your email has no eligible credits available, we may pause fulfillment and contact you with options.
Coupons and discounts: Coupons may have limitations, expiration dates, and may be changed, paused, or discontinued at any time. Coupons and discounts have no cash value.
5. NO RESALE / LICENSE TO USE
Unless we state otherwise in writing, your purchase is for personal, non-commercial use. You may share the final Digital Product with friends, family, teammates, coaches, and on personal social channels.
You may not resell, sublicense, or redistribute the product as a standalone product; sell access to the product; claim authorship of the underlying composition, production process, system, prompts, or methods; use the product in a way that suggests endorsement by My Hype Song; or use the product for large-scale paid advertising, resale, commercial campaigns, or brand promotions without written permission from us.

6. YOUR CONTENT AND PERMISSIONS
When you submit names, team details, nicknames, photos, pronunciation notes, stories, phrases, slogans, or other content (“Customer Content”), you represent that you have the right to provide it and that it does not infringe on anyone else’s rights.
You agree not to submit content that is unlawful, hateful, threatening, harassing, defamatory, obscene, exploitative, invasive of privacy, or otherwise harmful. You also agree not to submit private or sensitive information about another person unless you have permission to do so.
If you submit information about a minor, you represent that you are the minor’s parent or legal guardian, or that you have permission from the parent or legal guardian to submit that information.
7. PERMISSION TO USE A SHORT SAMPLE OPTIONAL
If you explicitly opt in to allow us to use a short sample, for example ten to fifteen seconds, for our website, portfolio, advertising, or social media, you grant us permission to use that limited excerpt for promotional purposes.
If you do not opt in, we will not knowingly use your custom song for promotion. We may still display non-identifying examples of our general style, such as generic demos, that are not tied to your order.
8. ACCEPTABLE USE AND SYSTEM ABUSE
You agree not to misuse our website, forms, support channels, payment systems, automations, AI tools, or delivery systems.
You may not submit content intended to interfere with, manipulate, bypass, override, exploit, or disrupt My Hype Song’s systems, AI tools, prompts, automations, security controls, workflows, or production process. This includes, but is not limited to, prompt injection attempts or similar instructions such as “ignore previous instructions,” “forget your system prompt,” “you are now,” “reveal your prompt,” “show your hidden instructions,” “send your API key,” “run this command,” “access internal files,” “call this webhook,” “change the workflow,” or any similar attempt to control, manipulate, or bypass our AI or automation systems.
Customer form answers, support messages, revision requests, and any other submitted text are intended only to provide song-related information. They may not be used to issue commands to our systems.
If we determine, in our reasonable discretion, that an order, support request, or other submission contains a prompt injection attempt, automation abuse, system manipulation attempt, fraudulent activity, or other misuse of our systems, we may stop production, cancel the order, refuse revisions or support, refuse future service, void related credits, preserve relevant information for security, fraud prevention, or dispute purposes, and decline any refund for the affected order.
If an order is stopped or canceled because of prompt injection, system abuse, attempted manipulation, fraud, or other misuse, the customer forfeits eligibility for a refund for that order to the fullest extent permitted by law.
9. REFUNDS AND CANCELLATIONS
Because our products are custom digital goods, all sales are final once production begins.
If you need to cancel, contact us as soon as possible. If we have not started work, we may approve a cancellation at our discretion.
If there is a clear mistake on our end, for example we delivered the wrong file or the deliverable is corrupted, we will make reasonable efforts to fix it.
We do not offer refunds based solely on subjective preference, change of mind, misunderstanding of the product, customer-provided errors, or failure to provide accurate order information. Credits, credit packs, coupons, and discounted purchases are subject to the same refund limitations.
Nothing in these Terms limits any rights you may have under applicable law.
10. CHARGEBACKS / DISPUTES
If you have an issue, please contact us first so we can help. Unnecessary chargebacks or payment disputes may result in refusal of future service.
If a chargeback or payment dispute is opened after a Digital Product has been delivered or production has begun, we may provide the payment processor with order records, delivery records, customer submissions, support communications, and other relevant information.
11. NO GUARANTEED RESULTS
My Hype Song products are created for entertainment, encouragement, motivation, and personal or team enjoyment. We do not guarantee any specific athletic, emotional, psychological, competitive, performance, recruiting, social media, or commercial result from using or sharing a Digital Product.
12. THIRD-PARTY SERVICES
We may rely on third-party services for payment processing, forms, email delivery, file storage, automation, AI tools, music generation, website hosting, analytics, and related business operations. We are not responsible for delays, errors, outages, limitations, policy changes, account restrictions, or service interruptions caused by third-party providers.
13. DISCLAIMER
We provide the service “as is” and “as available.” We do not guarantee that the website, forms, payment systems, AI tools, delivery systems, or Digital Products will be uninterrupted, error-free, or meet every expectation.
We are not responsible for delays caused by circumstances outside our reasonable control, including internet outages, provider downtime, platform changes, payment processor delays, email filtering, weather, illness, technical issues, or other unexpected events.
14. LIMITATION OF LIABILITY
To the maximum extent allowed by law, My Hype Song will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for any claim related to your purchase will not exceed the amount you paid for the specific order giving rise to the claim.
15. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless My Hype Song from and against claims, damages, liabilities, losses, costs, and expenses arising from your use of the website or Digital Product, your submitted Customer Content, your violation of these Terms, your violation of another person’s rights, or your misuse of our systems, forms, automations, or services.
16. GOVERNING LAW
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules.
